When New York Courts Will Modify Custody or Visitation

New York courts won’t modify a custody or visitation order simply because one parent is unhappy with the arrangement. To open the door to a change, the parent seeking it must first demonstrate a substantial change in circumstances since the prior order was entered. That’s a defined legal threshold, not just a showing that something has changed.

Common circumstances courts have recognized as meeting that threshold include a parent’s relocation, a significant shift in work schedule, remarriage, or a situation that raises concerns about a child’s safety. Once a substantial change is shown, the court asks a separate question: does the proposed modification actually serve the child’s best interests? That analysis weighs each parent’s stability, caregiving history, and the child’s specific needs. Both steps must be satisfied before any change takes effect.

Grounds for Modifying Child Support

New York gives parents three routes to revisit a child support order. A modification may be appropriate when there has been a substantial change in circumstances, when three years have passed since the order was last entered or modified, or when either parent’s gross income has changed by 15% or more since the order was last entered or modified (a decrease in income must be involuntary to qualify). A job loss, a significant pay cut, or a major increase in the other parent’s earnings can each potentially satisfy one of those grounds.

One timing detail matters a great deal: a child support modification takes effect only from the date the petition is filed. Courts don’t retroactively adjust support owed before that filing date, so waiting rarely works in your favor. When support is recalculated, amounts are determined under the Child Support Standards Act based on combined parental income and the number of children.

Spousal Maintenance Modifications

Maintenance orders can also be revisited when there’s a significant change in either party’s financial picture. A recipient who lands a substantially higher-paying job, or a paying spouse who loses theirs, may have grounds for a modification. Maintenance generally terminates when the recipient remarries, unless the parties agreed to different terms. Cohabitation with a new partner may also give rise to a modification request if the recipient is holding themselves out as that person’s spouse, depending on the specific facts.
