Two Paths to Legal Paternity in New York

New York recognizes two routes when parents aren’t married. The right one depends on whether both parents agree.

Voluntary Acknowledgment of Paternity

If both parents agree on who the father is, they can sign an Acknowledgment of Paternity. This written form, once filed, carries the same legal force as a court order. No courtroom, no judge. The father’s name can then be added to the birth certificate, and paternity is established. A proceeding can be brought any time from pregnancy until the child turns 21, so the voluntary route isn’t limited to the delivery room.

Family Court Petition & Order of Filiation

When parents don’t agree, either party can file a paternity petition in Family Court. The court can order genetic marker or DNA testing on the mother, child, and alleged father. If testing confirms the biological relationship, the court issues an Order of Filiation, which legally declares the man the child’s father. A petition may be brought by the mother, a man alleging to be the father, the child, the child’s guardian, or the Department of Social Services when the mother receives public assistance.

What Changes After Paternity Is Established

Once an Order of Filiation is in place or an Acknowledgment of Paternity is filed, the father gains standing to petition Richmond County Family Court for custody and visitation. He also becomes obligated for child support under the Child Support Standards Act formula. The child gains inheritance rights and may become eligible for the father’s health insurance and Social Security benefits. These rights and obligations take effect together; there’s no selecting only the favorable ones.
